General Terms: This legal note contains the terms which regulate the use of and access to the website http://www.perinox.com (henceforth, the site or website) and the responsibilities deriving from its usage, in compliance with Act 34 enacted on 11 July 2002 regarding Information Society Services and e-Commerce (henceforth, ISSEC). It shall be assumed that access to or the mere use of the website by the user entails the adhesion of the latter to all the terms that PERINOX S.A. has published at this time at the website. The users are informed that PERINOX S.A. respects the legislation in force on personal data protection, user privacy and the confidentiality and security of their personal data, adopting, to this end, the technical and organisational measures required to avoid the loss, misuse, alteration, unauthorised access and theft of the personal data provided.

   The purpose of this site is to inform about the products and services offered by PERINOX S.A. in the context of the development of solutions and installations for the food industry.
4. Intellectual and Industrial Property Rights:
   All of this website: description and characteristics, text, images, brands, logos, buttons, software files as well as the structure, selection, organisation and presentation of its contents are protected by Spanish and international laws about Intellectual and Industrial property. Under no circumstances does access by third parties to said site entail any kind of waiver, transfer or total or partial assignment of the rights granted by Spanish and international legislation on Intellectual and Industrial property.
   Reproduction (except for temporary download from the website to the hard drive of the user’s computer or to proxy servers), the copying, use, distribution, reuse, operation, making of back-up copies, el postal delivery, transfer, modification, assignment or any other act carried out with all or part of the information contained at this website which has not been specifically authorised by the holder. The user undertakes to use the contents in a diligent, correct and lawful manner, in particular, it undertakes to refrain from removing, avoiding or interfering with the “copyright” and other identification data of the rights of PERINOX S.A. or its holders incorporated in the contents, as well as the technical protection devices or any information mechanisms that may be included in the contents. www.perinox.com is a domain registered by PERINOX S.A. The domain may not be used, unless specifically authorised in advance, in relation with other services which do not belong to the company in any way that may cause confusion between our clients or discredit PERINOX S.A.

5. Access:
   Users may access the site free-of-charge without restriction. Nevertheless, Perinox S.A. reserves the right to limit access to certain areas of the website to those users that do not hold the right credentials. Said credentials (user and password) are provided by Perinox S.A. to its clients, or to those users who so specifically request, with a view to accessing specific information for said user group. Use of the password is personal and non-transferrable and assignment to third parties is not permitted, even on a temporary basis. With this in mind, the user undertakes to make careful use of the password and to keep it secret.

6. Data Protection and Confidentiality Policy:
   The personal and identification data provided in the context of the present website by way of a form or by e-mail, are confidential and shall form part of the files held by PERINOX S.A. They shall be processed by the latter in accordance with the legislation in force on personal data protection. Concurrently, the users specifically authorise PERINOX S.A. to send them information about the latest developments in the context of the services provided by the latter. In the event that they do wish to receive said information, it shall suffice to notify this by e-mail at any time. Upon acceptance of the present general terms, PERINOX S.A. Shall require the user to collect some vital data for the rendering of its services.

The personal data collected shall be subject to automated processing and incorporated by PERINOX S.A. into the attendant automated files, with PERINOX S.A. being responsible for said files, registered with the General Data Protection Register of the Spanish Data Protection Agency. The data entered on the forms by the user must be true, accurate, complete and up-to-date.

The purpose of the file is to serve as information support to the commercial and administrative management of Perinox S.A. Under no circumstances shall they be used for any other purposes or assigned to third parties.

The Data Controller or, where applicable, the Data Processor, shall carry out the security measures required to verify the identity of the user. However, in the event that the person who enters the data is different from the one who is going to be the user, it shall be assumed that he/she has the specific consent of the user to this end and that the latter has granted us authorisation to carry out the processing described above. The user shall be the sole party liable for any damage or loss, direct or indirect, which he/she may cause to anyone owing to completion of the form with data which are false, inaccurate, incomplete or not up-to-date.

The personal data subject shall have the rights of opposition, access, rectification and cancellation with regard to any of his/her data stored at the PERINOX S.A. data base. Said rights may be exercised through any media, provided that this has been duly recorded, vis-à-vis PERINOX S.A., situated at Ctra. N-310 P.K. 138,2 de Villarrobledo (Albacete), which reserves the right to modify its data protection and confidentiality policy as a result of a change in the legislation, case law or business practice. PERINOX S.A. is released from any liability with regard to any decision adopted by the user of the website. PERINOX S.A. rejects liability for any information not prepared by the Centre or not published in authorised fashion by it in its name, as well as any liability deriving from the misuse of the contents. Furthermore, with regard to the contents, PERINOX S.A. reserves the right to update them, remove them, limit them or prevent access to them on a temporary or permanent basis.

7.2. Liability with regard to links to other websites
Any links provided at www.perinox.com are of a merely informative nature and hence PERINOX S.A. does not control nor verify any information, content, products or services provided through these websites. Accordingly, PERINOX S.A. declines any kind of liability for any aspect, in particular the content, pertaining to linked sites. These linked sites, as well as the products or services offered by them, does not involve any backing, sponsorship, or recommendation by PERINOX S.A.

7.3. Liability in the event that this site is the destination of a link provided at another site
As regards any links provided by other sites to the site of PERINOX S.A., the following stipulations must be complied with: • Authorisation must be requested before providing the link and its granting must be specifically stated.
The link must be absolute and complete, in other words, it must take the user to the actual address of PERINOX S.A. and it must fully cover the full extension of the home screen. PERINOX S.A. shall do everything possible to provide a stable, long-lasting service, but under no circumstances does it guarantee the continuity of operation nor the operationality and availability of the website for reasons for which it is no liable. PERINOX S.A. shall not be liable for any direct or indirect damages, including damages to computer systems and the introduction of viruses to be found online, deriving from any Internet browsing required to use this website. For this reason, under no circumstances shall compensation be provided for any possible problems owing to system malfunctions.

7.5. Obligations of the users:
The user shall be liable for any damages that PERINOX S.A. may suffer as a result of its failure to comply with any of the obligations determined in this legal note. In any case, the user shall be liable for the truthfulness of the data provided, with PERINOX S.A. reserving the right to exclude from the registered services any user that has provided false information and to rescind the insurance contract requested, without prejudice to any other actions that may apply by Law.    These terms of use are subject to Spanish legislation. The terms appearing at this website are, in any case, subject to Spanish Laws and Courts. In the event of any disputes between the user and PERINOX S.A., the parties specifically agree to subject them to the Courts of Spain, with regard to the rendering of the service, specifically waiving any other venue.
